Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ASHIGEN SASU (“ashigen”, “we”, “us”), governing your use of the ashigen website and AI image-generation service (the “Service”). By accessing or using the Service you agree to these Terms and to our Content Policy and Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
The Service contains adult content. You must be at least 18 years old (or the age of majority where you live, if higher) and legally permitted to view adult content in your jurisdiction. You represent that this is true each time you use the Service. The Service is void where prohibited.
2. The Service
ashigen generates fictional, AI-created anime artwork from prompts and character models you select. Outputs are produced on demand. All depicted characters are fictional adults; see the Content Policy. We may change, suspend, or discontinue any part of the Service at any time.
3. Accounts
Accounts and authentication are provided through our identity provider (Clerk). You must give accurate information, keep your credentials secure, and are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or the Content Policy.
4. Coins, subscriptions & payments
- Coins are a prepaid, limited license to use generation compute on the Service. Each generation (including enhance and inpaint operations) consumes coins at the rates shown in the app. Coins have no monetary value, are not currency, are not redeemable for cash, and are non-transferable.
- Subscriptions grant a monthly allotment of coins plus the features for that tier. They renew automatically until cancelled. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.
- Billing is handled by our payment processor; we do not store full card details. Prices are shown before purchase and may change prospectively.
- Refunds. Except where required by law, all purchases are final and coins are non-refundable, including for unused coins, dissatisfaction with an output, or account termination for violation of these Terms.
5. Acceptable use
You agree to use the Service only as permitted by these Terms and the Content Policy, which lists strictly prohibited content. You are responsible for your prompts and outputs. You will not attempt to circumvent content filters, abuse, overload, scrape, or reverse-engineer the Service, or use it for any unlawful purpose.
6. Content & intellectual property
As between you and us, you own the outputs you generate, to the extent they are capable of ownership. Note that purely AI-generated works may not be eligible for copyright in some jurisdictions, and you are responsible for ensuring your inputs and outputs do not infringe the rights of others. You grant us a limited, worldwide licence to process your prompts and uploaded reference images solely to operate and improve the Service. We do not retain generated images (see Privacy Policy). The ashigen name, branding, and software are our property.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that outputs will meet your expectations or that the Service will be uninterrupted or error-free.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ashigen WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to indemnify and hold ashigen harmless from claims, damages, and expenses arising out of your use of the Service, your content, or your breach of these Terms or the Content Policy.
10. Termination
We may suspend or terminate your access at any time, including for violation of these Terms or the Content Policy. Sections that by their nature should survive (e.g., payments owed, disclaimers, liability limits, indemnity) survive termination.
11. Changes
We may update these Terms. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by notice. Continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-laws rules, and disputes will be resolved in the competent courts of Paris, France, except where applicable law provides otherwise.
